011. Platform Role and Policy Purpose
Vito Marketplace operates as a technology platform and digital marketplace intermediary in Thailand. Vito does not inspect, verify, or take physical possession of goods or services listed by Sellers. This Prohibited Items & Services Policy defines categories of content that may not be listed on the Platform under any circumstances. Vito reserves the right to remove any listing, restrict any account, and apply Enforcement Actions for policy violations at its sole discretion. Vito's ability to prevent all prohibited listings in real time is limited. Users have a responsibility to report suspected violations.
022. Absolutely Prohibited — Zero Tolerance
- Any item whose sale, possession, distribution, or import is illegal under Thai law.
- Narcotics, controlled substances, and any drugs regulated under the Narcotics Act B.E. 2522 (1979) of Thailand.
- Drug paraphernalia, equipment designed for drug use or production.
- Counterfeit or forged Thai Baht, foreign currency, or negotiable instruments.
- Counterfeit or fraudulently obtained identification documents, passports, or official permits.
- Stolen property or goods obtained through theft, fraud, or any unlawful means.
- Human organs, tissue, blood, or biological specimens for commercial purposes.
- Protected wildlife species, animal parts, or products derived from CITES-protected species.
- Explosive devices, grenades, land mines, or military-grade weapons of any kind.
- Child sexual abuse material (CSAM) or any content that sexualizes minors in any form.
- Services that constitute human trafficking, slavery, or forced labor.
- Malware, spyware, ransomware, or any malicious software or hacking tools.
033. Firearms, Weapons, and Dangerous Items
- Firearms, handguns, rifles, and shotguns unless explicitly permitted by Thai Firearms Act B.E. 2490 (1947) and pre-approved by Vito in writing.
- Firearm components, barrels, silencers, magazines, or conversion kits.
- Ammunition, cartridges, and explosive propellants.
- Stun guns, tasers, and electroshock weapons regulated under Thai law.
- Knives with blades designed as weapons (distinguished from kitchen/utility knives as determined by context).
- Pyrotechnics and fireworks beyond consumer-grade items permitted under Thai law.
- Hazardous chemicals, pesticides, and toxic materials regulated under Thai law.
- Recalled products with known safety defects.
- Counterfeit or non-certified medical devices and equipment.
044. Intellectual Property Violations
- Counterfeit goods bearing unauthorized copies of registered trademarks or brand logos.
- Replica or "inspired by" goods that mimic trademarked designs without authorization.
- Pirated software, digital games, operating systems, or applications.
- Unauthorized copies or reproductions of copyrighted books, music, films, or other creative works.
- Digital content distributed without a valid license from the rights holder.
- Listings that use a third party's trademark, trade name, or brand imagery without authorization.
055. Adult, Obscene, and Harmful Content
- Sexually explicit content, pornographic material, or services of a sexual nature.
- Escort services, commercial sexual services, or facilitating prostitution.
- Content that depicts, promotes, glorifies, or incites violence.
- Hate materials targeting any individual or group based on protected characteristics.
- Shock content, gore, or material designed to disturb or cause emotional harm.
066. Regulated and Restricted Items
- Alcoholic beverages: may only be listed in compliance with Thai Alcoholic Beverages Control Act B.E. 2551 (2008), including required age verification.
- Tobacco and nicotine products: subject to strict restrictions under Thai Tobacco Products Control Act B.E. 2560 (2017).
- Prescription pharmaceuticals: may only be sold by licensed pharmacies with valid Thai FDA authorization.
- Unprescribed medical devices and health products making unauthorized therapeutic claims.
- Financial products, investment schemes, and insurance: require valid Thai financial authority licensing.
- Lottery tickets and gambling services: regulated under Thai law; commercial gambling is prohibited.
- Pesticides and agricultural chemicals beyond consumer-grade: subject to Thai regulatory approval.
- Items subject to international trade sanctions applicable in Thailand.
077. Fraudulent, Deceptive, and Non-Physical Listings
- Ghost listings: items advertised as available that the Seller does not possess or cannot deliver.
- Listings with deliberately false descriptions, misleading photographs, or fabricated specifications.
- Pyramid schemes, multi-level marketing recruitment, and get-rich-quick offers.
- Listings that promise guaranteed returns, guaranteed outcomes, or unlicensed investment advice.
- Access to other people's accounts, personal data, passwords, or digital credentials.
- Fake reviews, social media followers, likes, or engagement metrics.
- Listings for illegal online services such as DDoS-for-hire or credential stuffing services.
088. Detection, Enforcement, and Reporting
Vito uses automated detection tools and human review to identify prohibited content. Prohibited listings will be removed without prior notice to the Seller. Sellers who list prohibited items are subject to immediate account suspension or permanent ban, depending on severity. Vito reserves the right to report listings involving illegal items to relevant Thai authorities in applicable circumstances, but does not guarantee that any report will be made or that any law enforcement action will result. Users who discover prohibited listings must use the Report function. Abuse of the reporting function is a policy violation.
099. Appeals
Sellers who believe a listing was incorrectly removed may submit an appeal through Vito's support channel within seven (7) days of removal. Vito will review appeals at its discretion. Zero-tolerance categories (Section 2) are generally not eligible for appeal. Vito's final decision on appeals is conclusive.
1010. Policy Updates
This policy may be updated as Thai law evolves or as new prohibited categories are identified. Vito will publish updates at vito.com/legal/prohibited-items. Continued use of the Platform after updates constitutes acceptance.
