011. Platform Role in Payments

Vito provides payment infrastructure for the collection of Platform Fees (subscription fees, listing fees, boost credits, and Vito Wallet top-ups). Vito is not a party to any payment made directly between a Buyer and a Seller for goods or services. Vito does not hold, escrow, or guarantee the transfer of funds between Buyers and Sellers. For peer-to-peer Transaction payments, Vito accepts no liability for payment failure, non-receipt, or disputes between parties. All peer Transaction payment risks are borne solely by the Buyer and Seller.

022. Platform Fees — Definitions

  • Subscription fees: recurring charges for Seller subscription plans providing enhanced Platform features.
  • Listing fees: charges for creating or renewing individual listings in applicable categories.
  • Boost credits: purchased credits used to promote listings in search results and category pages.
  • Vito Wallet top-ups: funds added to the in-Platform Vito Wallet balance.
  • Transaction processing fees: charges applied to certain payment processing operations.

033. Accepted Payment Methods

Vito accepts payment via internationally recognized credit and debit cards (Visa, Mastercard), locally available Thai payment methods, and Vito Wallet. All payments to Vito for Platform Fees are processed through Vito's certified payment service providers. Vito does not directly store full card numbers, CVV codes, or sensitive authentication data on its systems.

044. Vito Wallet

  • The Vito Wallet is a non-monetary, in-platform credit facility for use within the Platform only.
  • Vito Wallet is not a bank account, e-money account, or regulated financial product under Thai law.
  • Wallet credits may only be used for Platform Fee payments and applicable in-Platform features.
  • Wallet credits are non-transferable to other Users and carry no monetary value outside the Platform.
  • Wallet credits do not accrue interest and Vito is not liable for any loss in Wallet value.
  • Vito reserves the right to expire Wallet credits that have been inactive for more than 12 months.

055. Subscription Plans

  • Subscription plans are recurring charged services that renew automatically at the end of each billing period.
  • The features, pricing, and terms of each plan are as published on the Platform's subscription page.
  • Subscription billing dates, amounts, and applicable taxes are stated at the time of purchase.
  • Vito may modify subscription plan features or pricing with at least thirty (30) days' advance notice.
  • Downgrading or upgrading plans takes effect at the next billing cycle.
  • Cancelling a subscription stops future renewals but does not result in a refund of the current billing period.

066. Refund Policy — Near No-Refund Baseline

Platform Fees paid to Vito are non-refundable as a baseline policy. Vito will not provide refunds for subscription fees, listing fees, expired or used boost credits, or Vito Wallet top-ups, except in the following limited circumstances that are expressly required by applicable Thai consumer protection law: (a) a demonstrable technical failure by Vito that prevents the delivery of a paid service, for which no alternative remedy is available; (b) a duplicate charge resulting from a verified billing system error; (c) any situation in which Thai law expressly mandates a right of refund that cannot be contractually excluded. Refunds for peer Transaction payments (between Buyers and Sellers) are entirely outside Vito's control and responsibility. Vito does not process, mediate, or guarantee refunds for any peer Transaction payment under any circumstances.

077. Chargeback Policy

Users who initiate a chargeback or payment dispute with their bank or card issuer without first contacting Vito support and providing a reasonable opportunity to resolve the issue are in breach of these Terms. Chargebacks initiated in bad faith will result in immediate account suspension pending investigation. Vito cooperates fully with payment processor chargeback investigations and reserves the right to provide transactional evidence to contest fraudulent chargebacks.

088. Taxes and Currency

All Platform Fee prices are stated in Thai Baht (THB) inclusive of applicable Value Added Tax (VAT) at the prevailing Thai rate, unless otherwise stated. Users are solely responsible for reporting and paying any income tax, business tax, or other tax obligations arising from their Transactions under applicable Thai tax law. Vito is not a tax advisor and provides no tax guidance.

099. Subscription Failure and Account Downgrade

If a subscription payment fails, Vito will attempt to collect payment up to two additional times within seven (7) days. If payment remains uncollected, the subscription will lapse and the account will revert to free tier with corresponding feature limitations. Users will be notified of payment failures and given opportunity to update payment details.

1010. Limitation of Liability

Vito's total liability for any payment-related claim shall not exceed the amount of the disputed Platform Fee transaction. Vito is not liable for any financial losses arising from peer Transactions, including non-delivery, non-payment, fraud, or disputes between Buyers and Sellers. Users assume all financial risks in peer-to-peer Transactions.

1111. Governing Law

These Payment Terms are governed exclusively by the laws of the Kingdom of Thailand, including applicable provisions of the Thai Electronic Transactions Act and consumer protection legislation.
